BOOKINGS

All purchases and transactions made through this website or by telephone through customer service are subject to the following terms and conditions which are assumed to be known and accepted at the time of the completion of the above activities.
Any variation and / or modification of these conditions and terms will be ineffective if not via written communication and approved by the company providing the service.
At the moment of the purchase, these conditions and terms will be fully incorporated and accepted by the user, none excluded.

In case of any doubts regarding Terms and Conditions interpretation, guests must contact the company before confirming the booking.
All services are provided by AroundVesuvio. Some services or part of them could be provided by third parties (local partners / suppliers) directly contacted by Di Paolo s.r.l ..

General

BOOKINGS
It is the customer's responsibility to provide all correct and necessary details at the time of booking.

PROMOTIONAL CODES
If you have a coupon code or are a holder of a discount, it must be applied BEFORE purchasing.
Promotional codes cannot be combined, consolidated, transferred or reused, unless otherwise indicated by the company. All promotional codes have an expiration date, if it is not indicated, that is expressly intended after 30 days of issue.

PAYMENTS
AroundVesuvio accepts payment by credit card (Mastercard, Visa, American Express) and through the Pepal circuit. Payment must be made before the scheduled service. The amount will be charged to your credit card in Euros or to your Paypal account.

CANCELLATIONS
Cancellations made by customers must be requested via e-mail and the cancellation date will be calculated based on the Italian time zone.
If a cancellation request is received within 7 days of the service, there will be no charge and, if the payment has already been completed, the sum will be fully refunded. If this request is received less than 7 days after the service, the full amount will be charged and you will not be entitled to any refund.

The same conditions apply to "no shows", or to cases where guests are absent from the purchased event.
The refund will be made using the same payment method. In case of use of credit cards with monthly charge, the amount will be credited at the end of the current billing period. The exact date of the refund depends on the conditions agreed in the user's credit card contract. The refund by bank transfer will take place within fifteen working days from the request.

NOTE: If when purchasing the tour you have chosen to also purchase entrance tickets (Pompei Scavi, Vesuvius, etc.), these are non-refundable, exchangeable and transferable. If the tickets have already been purchased when you choose to cancel or change the tour date, the entrance tickets will not be refunded.
In case of tour cancellation, the user won’t be able to get the tickets selected at the time of booking anytime.

FORCE MAJEURE
If a site, attraction or visit in the scheduled tour service / itinerary is closed due to force majeure, including strikes, adverse weather conditions or other unforeseen closures, the Company will have the opportunity, if beforehand aware of it, to contact guests and offer a replacement tour, reschedule a different service or provide a refund, pending availability. In cases where once the destination has been reached independently or aboard the vehicles of AroundVesuvio and / or local partners, the same is not usable for reasons related to force majeure, adverse weather, strikes or extraordinary events, the Company is exempt from any liability, proposing, where possible and at its sole discretion to the customer alternative solutions.

TRAVEL INSURANCE
The price of the service does not include any insurance. It is the user's responsibility to provide adequate insurance protection. The company strongly advises guests to take out travel insurance that can cover cancellations and delays due to unforeseen circumstances or force majeure (for example adverse weather conditions, strikes, earthquakes) etc. Guests are also advised to take out medical and personal insurance to cover any medical expenses, loss of baggage, loss of personal belongings or other similar travel accidents. Guests agree that both the company and local partner operators are not responsible for any of these unforeseen circumstances and hold both parties harmless. All refund requests under a travel insurance taken out by the customer must be sent directly to the insurance company and never through AroundVesuvio.

EXTRAORDINARY CANCELLATION
AroundVesuvio or partner / supplier can cancel the activity on the agreed date without notice in the event that meteorological conditions, official measures, strikes or other external conditions (unforeseeable and inevitable and due to force majeure) make the activity impossible, considerably more difficult, risky and dangerous. In such cases, the price paid will be refunded in full, with the exception of entrance tickets to sites, museums, etc. , referred to in the "cancellation" section.

EXCLUSION FROM PARTICIPATION
AroundVesuvio or the supplier is authorized to prevent users from joining an activity or to exclude them from an activity if they do not meet the participation requirements.
The exclusion from participation of the users will be applied if they represent a danger to them or someone else, or their long-term participation makes the activity impossible for any other reason. The same applies to users reported by the staff or other passengers in cases of behavior not in line with the general education, morality as well as the principles in line with AroundVesuvio and its code of ethics. In such cases, the price paid cannot be refunded.

COMUNICAZIONI
Any correspondence between user and providers must be held via AroundVesuvio platform. To allow quick communication, we advise the use of the booking forms available on AroundVesuvio website.

PROGRAM CHANGES Furthermore, AroundVesuvio or partner / supplier reserve the right to make non-essential changes to the program where necessary for unforeseeable or unavoidable reasons or linked to conditions that could hinder the normal and safe tour progress.

LIABILITY OF THE TOUR OR TOURIST SERVICE PROVIDER
AroundVesuvio or the supplier are responsible for the tours / services in accordance with applicable law, and liability is excluded in the cases provided by current legislation.

MODIFICATION OF GENERAL CONTRACTUAL CONDITIONS
These General Contractual Conditions of the Tour Provider and other tourist services may be modified at any time and without notice for future bookings.
Conditions and terms in force at the time the booking is finalized will be applied to each booking. Under no circumstances the application of conditions no longer in force will be permitted.

MODIFICATIONS OF GENERAL USE CONDITIONS
AroundVesuvio may modify General Use Conditions at any time and with immediate effect from the date of their publication on the Website. Users are required to regularly check this section to be aware of any updated version of the General Usage Conditions. Any further use of the Website following a modification is equivalent to the consent of the users to the same modification.

AroundVesuvio EVALUATION FUNCTION
Users have the opportunity to enrich the content of the platform by writing travel reports in the form of evaluations or by uploading photos. Users are solely responsible for the content made available to them, ensure the correctness of the content and guarantee that it does not contain statements and / or details against mandatory rules, public order and morality. Furthermore, the user guarantees that the content does not violate the rights of third parties. AroundVesuvio does not own the user content in any case, but it only makes its own platform available.
AroundVesuvio may use user content in various ways, including the right to publish it on the website, reformat it, modify it for clarity or grammar improvements, incorporate it into advertisements or otherwise.
AroundVesuvio may remove or report user content where necessary and at its sole discretion. For example, AroundVesuvio may remove user content if it violates, in the opinion of AroundVesuvio, the principles of AroundVesuvio for content. AroundVesuvio is not obliged to keep a copy of the users or to make copies of that available. AroundVesuvio does not guarantee the confidentiality of user content.
Users will in no case be able to claim financial recognition for the material posted on the platform

Users must completely exempt AroundVesuvio and its partners or suppliers from any claim raised by third parties (including legal fees) against AroundVesuvio and concerning the user content made available by the user. The same also applies if the contested content is no longer accessible on the platform.

ADDITIONAL CONDITIONS
These Contractual Conditions represent the only agreement between AroundVesuvio and the user. The relations between the parties, for all that is not provided herein, will be governed by Italian law and the Consumer Code.

The exclusive place of jurisdiction is Torre Annunziata. The mandatory legal provisions relating to the competent court are reserved.

Transfer services


LUGGAGE
When booking a private transfer, quotes are provided including 1 carry-on bag and 1 hold bag for each passenger.
If the number of bags exceeds the number above indicated, the customer must communicate it at the time of the request. There is a surcharge of € 5.00 for each additional hand baggage and € 10 for each hold baggage. In these cases, booking is completed on the site by paying the basic fee, while the supplement will be paid at the time of pick-up.
In no case AroundVesuvio will be responsible for luggage.

DELAYS
Transfers to and from any destination (including airports, ports and stations) do not include waiting. However, the Company offers a free wait of up to 20 minutes starting from the time indicated when booking the service. Any additional time to those 20 minutes will be charged at the standard hourly rate of € 35.

It is the customer's responsibility to contact us for any changes in travel itineraries, arrival / departure times in a time reasonable for making such changes and organizing the required changes to the service.
Di Paolo s.r.l. is expressly exempt from any liability in the event that, following any changes to travel itineraries, arrival / departure times, communicated by users, might be unable to guarantee the services.

It is the customer's responsibility to correctly fill in the booking form indicating the place of departure and arrival, the reference time considering the current time in Italy, the number of passengers, contact name and their telephone number complete with international prefixes.
NOTE: In the case of transfers to and from airports, please take into account the check-in closing times and any other constraint or limit not dependent on AroundVesuvio as well as the time required for baggage retrieval and the like. The time indicated for the pick up by the customer will not be analyzed and associated with any flight on our part, therefore AroundVesuvio disclaims any responsibility in this regard.

It is the customer's responsibility to have all necessary valid passports, visas and other travel documents required and to arrive at the scheduled departure point and at the correct time. We decline any responsibility in case of missed flight / train or any extra expenses that the delay or no show could cause you. No refunds are due for failure to show up in time for the transfer. AroundVesuvio will never be held responsible for lost flights / trains / ships / ferries, even in the event of accidents, motorway closures, strikes, demonstrations or any other event that may lengthen / change travel times.

SERVICE DURATION
The duration of the service indicated on the site at the time of booking should be understood as an estimated / indicative value. AroundVesuvio and partners will do everything possible to respect the execution of the service in the indicated time. However, it should be understood that this duration could decrease or increase according to the season in which the service is provided, to traffic conditions any other event that could compromise its normal performance. In this regard, no responsibility is accepted, both regarding start and end times of the service.

CANCELLATION
For cancellation, the provisions of the general conditions of sale apply.

EXTRAORDINARY CANCELLATION
For the extraordinary cancellation by AroundVesuvio or one of the partners designated for the service, what stated in general sale conditions will apply.

AGE DECLARATION
The incorrect compilation of booking form and any incorrect selection of children or categories for which discounts are reserved, will result in the ineligibility of the service. In case of discrepancies these will be evaluated and if possible the tour will take place once any discrepancies have been remedied. In this case we will proceed at the discretion of AroundVesuvio in the most appropriate ways.

VEHICLES ASSIGNMENT
The vehicle assignment will take place at AroundVesuvio's discretion, always following the criteria of corporate and logistical standards as well as of reasonableness, prudence and comfort.

Private Tours

We decline any responsibility in case of missed flight / train or any extra expenses that the delay or no show could cause you. We also decline any responsibility related to failure to access museums, churches and the like due to missing the required documents or requirements. We also remind you that the concessions regarding the cost of entry for categories such as students, invalids, etc. are strictly connected to the possession and display (where requested by the staff of the site you intend to visit) of a valid title certifying belonging to these categories. No refunds are due for failure to show up on time for the service.

Shared Service


LUGGAGE
When booking a SHARED service, provided quotes do not include oversized luggage but only a maximum of 1 hand luggage per person or backpack of the same size.
If the number of bags exceeds the number indicated above, the customer must inform at the request time. There is a € 5.00 surcharge for each additional hand baggage and € 10 for each hold baggage. In these cases, the booking is completed on the site by paying the basic fee, while the supplement will be paid at the time of pick-up.
In no case the AroundVesuvio will be responsible for them.

DELAYS
Upon confirmation of your service you will receive a voucher with place and time of collection. If you expect to be delayed for any reason, it is your responsibility to contact the number indicated on the voucher.
The waiting time will be 15 minutes after the departure time, after which we will consider it a "NO SHOW" and apply the relative cancellation policy. For tours that include stops with free time, it is the customer's responsibility to pay attention and respect the indicated time when he will be picked up again, that will be communicated by the staff. Again, the maximum waiting time will be 15 minutes after indicated time, after which the tour will continue without delayed passengers. In case of doubts or misunderstandings, contact the numbers shown on the voucher immediately. AroundVesuvio will not be responsible in any way for any misunderstanding about the time and place of meeting / collection of passengers and for what derives from this.

However, in exceptional cases such as sudden vehicle breakdowns, busy days or due to force majeure independent from AroundVesuvio, AroundVesuvio may replace the vehicle used for the service and this could possibly change the number of participants while still guaranteeing the same service and transport standard.

Guided Tour Services


REGULATION
By booking a guided tour service, the client agrees to follow the museum/site regulation, together with present terms and conditions.

LUGGAGE
If you are traveling with a lot of luggage it’s advisable to check if access is allowed and how it is regulated by the site / museum itself. In case of need, the AroundVesuvio customer service can be contacted in advance.
If you have added a guided tour as an extra service by purchasing a private or shared tour, you can leave your luggage free of valuables inside the vehicle you are traveling with.
In no case the AroundVesuvio will be responsible for them.

BOOKING CONFIRMATION
Once on-line payment is made, you will receive a voucher containing all the service’s details and information. It is the customer's responsibility to control that it is correctly filled in and that informations contained there regarding children, minors, disabled people or others are true. In case of discrepancies, please inform AroundVesuvio before the tour. If such discrepancies emerge at the time of the tour, the same will be assessed and if possible the tour will take place once discrepancies have been fixed. In this case we will proceed by AroundVesuvio discretion in the most appropriate ways. For museum/site tickets purchased in advance according to the customer's incorrect indications, the customer will have to repurchase the ticket once he arrives on site on the day of the service. Wherever possible in terms of time, and upon acceptance of AroundVesuvio, it is possible to pay the price of the same tickets again to AroundVesuvio who will take care of the purchase.

RITARDI
Upon confirmation of your service you will receive a voucher with meeting place and time. If you expect to be delayed for any reason, it is your responsibility to contact the number indicated on the voucher.
The waiting time will be 15 minutes after the service starting time, after which we will consider it a "NO SHOW" and apply the related cancellation policy. AroundVesuvio will not be responsible in any way for any misunderstanding about time and place of meeting / collection of customers and for whatever comes with it.

Customized tours


For the services of a customized tour / package, the company will provide assistance through its team and travel agents, allowing any changes up to 2 times. If a guest wishes to make any changes to an itinerary beyond the second personalized tour offer, there is a non-refundable service fee of € 250. This service fee will be collected via credit card payment. At the time of booking, this fee will be deducted from the total amount due for the tour service.

PAYMENT
When entering into a booking contract, a credit card is required to guarantee the services and a deposit of 30% paid upon confirmation. The remaining 70% is due one month before the first day of service. Credit card payment is available with a 3% service fee added to the total amount due. Payment by bank transfer is available at no additional cost.

CANCELLATION POLICY
Written requests for service cancellation must be sent to our company at least 30 days before the scheduled start date of the service: after these terms, the entire account balance will be charged to the credit card provided at the time of booking. If the cancellation is made within these terms, a full refund will be provided, less the cost of the non-refundable custom tour design service of € 250, if applicable.
